In support of our Corporate Plan, we continue to grow as an organization and employer of choice. We are currently expanding our Commercial Management team and seeking a Director of Commercial Management.

Our ideal candidate is a dynamic and innovative leader focused on establishing a team to deliver commercial services while building strong relationships with internal clients, key stakeholders and senior leadership. POSITION SUMMARY

Reporting to the Head, Commercial Management, the Director of Commercial Management will lead all initiatives for the post-contract management of a portfolio of contracts. Supported by their team, the Director will be a strategic resource to various business units through the delivery of projects from inception to completion. The Director will be accountable on all commercial activity undertaken within the team and the development of processes and procedures, contributing to the departmental roadmap and framework.

SCOPE & RESPONSIBILITIES

The duties of this role will include but are not limited to the below:

  • Lead the full lifecycle of commercial management, supporting contract inception and development through to leading the implementation and close-out
  • Develop and lead a high-performing team; ensuring effective teamwork, the delivery of organizational goals, best practices and a high standard of service to business units and key stakeholders
  • Provide strategic leadership and training to ensure adherence to relevant policies, standards, and legislation
  • Foster strong relationships with business unit leaders, vendors, and other key partners to support successful contract management and administration
  • Develop and implement comprehensive processes and procedures to enhance commercial management practices
  • Provide guidance and support to ensure compliance with corporate governance requirements
  • Develop and implement supply chain and vendor-related strategies
  • Ensures all business-to-business transactions for goods, services, and works are conducted in compliance with corporate policies and standards
  • Manage the development and delivery of training and procedures related to procurement processes, strategies, and policies
  • Manage all aspects of contract administration including strategic commercial direction, claims management and risk mitigation
  • Monitor contract compliance and the commercial viability of all business unit contracts ensuring alignment with TTC's financial planning, management and reporting programs
  • Partner with business unit leaders to ensure the successful delivery of contractual obligations and assist in mitigating risks against deliverables
  • Lead high value or high risk claim negotiations and develop negotiation mandates for Executive endorsement
  • Lead the management and resolution of legal and commercial disputes (notice of non-payment)
  • Promote and maintain professional working relationships and communications among staff, management, officials and external stakeholders and fostering a positive work environment
  • Ensure passengers and/or employees are treated with respect and dignity and ensure the needs of passengers or employees with disabilities are accommodated and/or addressed (if applicable and within their area of responsibility) in accordance with the Ontario Human Rights Code and Related Orders so that they can fully benefit from the TTC as a service-provider and an employer

KEY SKILLS & QUALIFICATIONS

  • Extensive experience in managing projects and contracts in a multi-functional environment; proven experience working on both capital and operating contracts, including high value and high complex contracts and projects
  • Experience in contract law, and Ontario legislation (e.g. Construction Act, Professional Engineers Act, Canadian Construction Documents Committee documents, bespoke contract documents, specifications and drawings, and legal statutes and proceedings)
  • Proven experience in managing high value and complex claims
  • Demonstrated experience in developing and mentoring a large multi-level team, providing training, and succession planning for long-term growth
  • Excellent interpersonal and communication skills to liaise with all levels within the organization and in the field, and collaborate effectively with specialists across multiple sectors
  • Strong oral, written and presentation skills; specifically a high level of comfort engaging senior leadership, vendors, and contractors
  • Detailed knowledge of LEAN, quality assurance and quality control principles and methodologies as it relates to the implementation of controls for contract management processes
  • Knowledge of risk management systems and processes to identify and mitigate risk
  • Must have or rapidly acquire a comprehensive knowledge of the Ontario Human Rights Code and Related Orders including disability accommodation and accessibility requirements pertaining to passengers and employees

EDUCATION & PROFESSIONAL CREDENTIALS

  • A University Degree, College Diploma in a related discipline (i.e., Civil Engineering, Quantity Surveying, Contract/Construction Law, Business Administration, etc.) or a combination of education, training, and experience deemed to be equivalent
  • Certified Construction Contract Administrator (CCCA), Project Management Professional (PMP), Professional Engineer Ontario (P.Eng.), Royal Institute of Chartered Surveyors (RICS) or similar designation would be considered an asset
